| Published: August 15, 2008 OZARK - A $2 million claim alleging libel, defamation and false arrest during a murder conspiracy case that was later dismissed has been filed with the Dale County Commission and the City of Hartford, according to officials. According to documents filed by Birmingham attorney Sam Hill on behalf of Fred and Garret Daniels of Pinckard, the Daniels are seeking $1 million each for being “denied due process of law because of the conduct of Dale County” and being subjected to “felonious injury ... intentional infliction of emotional distress; and outrage.” The two men were charged and jailed under $3 million cash bonds each earlier this year after allegations that they contracted to kill Dale County Circuit Judge Ken Quattlebaum, attorney Buddy Williams and Garret Daniels’ ex-wife, Sharmon, and to assault Fred Daniels’ ex-son-in-law, Tim Williams. A claim is typically a formality submitted to a government body before a legal complaint is filed. A draft legal complaint attached to the claim listed potential defendants in a federal lawsuit as Williams, the City of Hartford and its police chief, Nick Finer; and Dale County Sheriff Wally Olson. According to the complaint, Williams made allegations on Jan. 30 that the Daniels had contracted with a hit man to kill and assault the individuals. The draft complaint also alleges Finer pursued an investigation against the Daniels “without probable cause and without consent,” and that Olson detained the men in the same manner and stated allegations as “facts.” The draft complaint asks for at least $10 million in compensatory damages and demands the trial be heard by a jury. | I BELIEVE THE D.A. ,. ACTED IRREGULARILY BECAUSE OF PREMATURE PRESSURE FROM A CERTAIN JR. ICON... THAT ACTED WAYYYYYYYYYYYYYYY TOO SOON . | The only one to blame here is Williams,for not saying anything alot earlier,and Hartford police,if the the undercover guy was a Hartford policeman.If the tape had been clearer,it would be a different story.As for Wally Olson,he did just what he was suppose to do with what they had,and Kirk Adams too.Go Get Umm Kirk!!! | | | |

| sometimes LE can be too quick to jump the gun. maybe the dale co guys thought the evidence was adequate but apparently it was not. beware of convoluted kin and family ties..... i sure don't think wo or the da would run with this w/o proof. more to the story!! i'm betting | | ~~Some days it just doesn't seem worth the effort to gnaw through the straps...~~

| The people who made the arrest are the ones to blame not Williams. Its sad what Mixon spent his life building has been destroyed in less than two years. | Let us not forget, they have allmost the same charges against them in Florida (conspired to kill a Judge), and Florida's charges remain! Also what about the horse being shot with a pellet gun (multiple times)? It kinda tells me that someone has a tarnished Halo! | | | |

| sorry you are very wrong, charges in Florida were very different. and no mention of conspiracy to kill a Judge at all. I don't know where you are getting your info from but you are very wrong. | Well W.O is to blame he was wrong for his actions, Like he said he did not even listen to the tapes.. he did not know what was going on, all he could do was get in the lime light and arrest these people on hear say..great job.. I cant believe we have a sheriff like that I am ashamed to live in Dale county. He is a joke  | | | |

| I truly hope the Daniels get every thing they deserve they are truly good people and everyone that knows them will tell you the same. I think Garret should run for next Sheriff I think he will clean dale county up and give it a good name.. You go Daniels we Love you and support you 100% | | | |

Kirk Adams (The District Attorney) made the statement in his press conference when he released the Daniels that he (Kirk Adams) issued warrants without listening to the tapes. It is his (Kirk Adams) job to either make sure their is enough evidence or put it before a Grand Jury for the Grand Jury to decide if there is enough evidence to issue an arrest warrant. As for Wally, once he is handed a warrant he has to serve it. That is his job, it is not multiple choice. I agree that the Daniels rights have been violated but the blame is between the sorry investigation of Nick Finer and the D.A.'s lack of doing his job by first looking over the evidence or taking this before a Grand Jury before he issues a warrant. Of course what do you expect when the people elect a D.A. who has never tried a criminal case before he was elected into office. | | | |

| Hey Bluebeard, I believe there was evidence,and because of not Kirk Adams nor Wally Olson,something went array with either the informant or the tapes.I do believe that.I also believe Kirk Adams is a good DA,and had to do what he had to do until theres more evidence,I believe this.They tried this befour,the Daniels,they just got a lil lucky this time,its not over.Maybe they should have gone befour a grand jury first,and I believe there was a reason why they didnt.Thats my belief.If the attorney had told the DA this and the Sheriff way befour he blutted it out in the judges court room,this would probably have been a lot different... | | | |

| Guys, come on I think there are a few people out there who needs to go over what was said again. Also I along with several others was in the court room when W,O admitted to NOT listening to the tapes, He also thought is was funny because he laughed while admitting to it!!. May be some people should dig in there pockets and pay a little money to get the transcript they reveal every thing, Or are you stating transcripts are a bunch of lies also?? You people who are protecting W.O I am afraid that you will have a rude awakening when it all comes out very soon. There is a saying You can fool some people most of the time, But not all the time. After spending two months in the Dale County Jail, all charges were dropped against the men because of a lack of credible evidence. Now, they're fighting back with a lawsuit. "If this can cause’ it to not happen to someone else, I just hope it don't happen to anyone else like this; that nobody else is having to go through what we're having to go through," Fred added. Dale County Attorney Henry Steagal said, "That claim alleges that the two Daniels gentlemen were falsely arrested, maliciously prosecuted; that they were illegally confined in the Dale County Jail and they alleged other various federal claims of their constitutional rights." Attorney Steagal says cases like these are rare. And, that it’s unfortunate for both parties involved. "It's just an unfortunate situation all around, unfortunate for the Daniels’ of course, but it's also unfortunate for the sheriff and the county in the way this is ending," he continued. Fred says no matter what happens, he, along with his family just want to get back to the way things were. "We would like to get some sort of semblance of what our life was before and we don't know whether we can ever get close back to that again." | OK now after all that was done, you say that the Taxpayer is responsible because W.O. Took the warrent From the D.A. and made the arrest like the Judge for the State Ordered! I don't understand, Why should I have to pay? | | | |
